Video Contest Rules CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 YEARS OR OLDER, AND SHALL BE CONSTRUCTED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA. NO PURCHASE NECESSARY. Sponsored by NESTLÉ® USA, Inc. To enter: Log on to www.youtube.com/nesquikcontest between 12:01 a.m. ET 03/17/08 and 11:59 p.m. ET 09/05/08 and log into your account or register with YouTube. You must be a member of the YouTube Web site and comply with its terms and conditions to enter the contest. Membership is free. Follow the onscreen instructions to enter and upload your video submission ("Entry"). Entry: NESQUIK will air a TV spot where a man is transported to his "Happy Place" after drinking NESQUIK (available for viewing at the Web site). Video entry should convey the following: "Where does NESQUIK take you and what is your 'Happy Place' when you drink NESQUIK?" Video Entry must feature/include NESQUIK branding, logos, icons or packaging for 10 seconds within the video. Creative assets will be available at www.youtube.com/nesquikcontest. Enter as often as you wish; however, each entry must meet the requirements below and must be submitted separately. Entrants are required to agree to these Official Rules at the time of entry by using the accept feature at the Web site. Entries must be received by and contest ends at 11:59 p.m. ET, 09/05/08. All Web site entrants must have a valid e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared/made by the registered user (meeting eligibility criteria) of the YouTube account, and if a prize is won, it will be awarded to that registered user. Entries generated by a script, macro or other automated means will be disqualified. Entry must meet all of the following requirements or it will be disqualified.
Judging: Judges will select Forty (40) Second Prize Winners and Ten (10) Finalists from all eligible entries received. Entries will be judged on 50% originality, 25% humor and 25% creativity. Second Prize Winners will be notified via their YouTube account on or about 09/26/08 and asked to provide a mailing address for Prize fulfillment and return to NESTLÉ USA ("Sponsor") as set forth in the notification by 10/27/08. Finalists: Finalists will be notified on or about 09/26/08 and will be required to sign a release, and provide a signed release for any other Participants featured in or who otherwise contributed to the video Entry (as stated in the requirements section above), and return to Sponsor by 10/03/08 or finalist will be disqualified and will forfeit any prize, and another finalist may be selected. Finalists must also supply a high-definition, high-resolution file of their original uncompressed Entry in either 720x540 or 640x480 format of their choice (e.g., .mov, .avi., .wmv or .mpg) on a data DVD to Sponsor by 10/03/08, before the announcement of the winner. Finalists' Entries will be featured on www.youtube.com/nesquikcontest between 12:01 a.m. ET, 10/06/08 and 11:59 p.m. ET, 10/24/08 during which time YouTube members may vote for their favorite video based on the judging criteria above. You must be a registered YouTube member to vote. The entry that receives the most votes by 11:59 p.m. ET, on 10/24/08 will be determined the Grand Prize Winner, pending verification. The remaining Nine (9) Finalists will be determined First Prize Winners, subject to verification and meeting video entry and eligibility requirements. Winners will be notified on or about 10/30/08. In the event of a tie, judges will determine the Grand Prize Winner based on the original judging criteria. Prizes: One (1) Grand Prize Winner will receive a $10,000 cash prize, a NESQUIK necklace, and a one-month supply of NESTLÉ NESQUIK flavored milk (30 coupons each good for one FREE package of any NESTLÉ NESQUIK flavored milk, up to $3.99). (ARV $10,154.70). Nine (9) First Prize Winners will receive a $250 cash prize, a NESQUIK necklace, and a one-month supply of NESTLÉ NESQUIK flavored milk (30 coupons each good for one FREE package of any NESTLÉ NESQUIK flavored milk (up to $3.99) (ARV $404.70). Forty (40) Second Prize Winners will receive a NESQUIK necklace and a one-month supply of NESTLÉ NESQUIK flavored milk (30 coupons each good for one FREE package of any NESTLÉ NESQUIK flavored milk (up to $3.99) (ARV $154.70). Expenses not specifically stated are the sole responsibility of the winner. No cash substitutions for prizes; prizes are nonrefundable and nontransferable, except at the sole discretion of Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. Federal, state and local taxes are the sole responsibility of the winner and winner of any prize over $600.00 must provide their information, including Social Security number, for tax reporting purposes or prize will be forfeited and another winner may be selected. Total ARV for all prizes is $19,985. If a winner is an eligible minor in their jurisdiction of residency ("Minor"), all paperwork will be required to be executed on said minor's behalf by his or her parent or legal guardian. Winners: Winners will be required to sign a Winner's Agreement and Release and return it by 11/05/08 or prize will be forfeited in its entirety and another winner may be selected. By submitting an entry, a winner agrees to allow use of his or Entry, name and/or likeness for advertising this or similar promotions without compensation, unless prohibited by law. All entries and all rights of ownership and publication of same will become the property of Sponsor and will not be returned. Eligibility: Contest open to legal residents of the 50 United States and the District of Columbia, 18 years or older, except employees and the families of NESTLÉ USA, Inc., YouTube, Inc., their respective affiliates, subsidiaries and agencies. NESTLÉ USA, Inc., YouTube, Inc., their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by, the prize winner and entrants against any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize and from any and all use of the video entries. Void where prohibited or restricted by law. Subject to all federal, state and local laws. Other conditions: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest by any technical or human errors which may occur in the processing of the entries in the Contest. Sponsor reserves the right to withdraw the transmission of this Contest at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or Web site or to be acting in violation of the Rules. Sponsor is not responsible for entries, releases or other required filings, whether electronic or paper and however returned to Sponsor or its agents, that are illegible, late, tampered with, forged, incomplete, misdirected, lost, misplaced, stolen, destroyed or otherwise not in compliance with these official rules, and all such entries will be disqualified.
